Kessler & Williams (“K&W”, “we”, “our”, or “us”) may contact consumers using text messages (SMS/MMS), email, and other electronic communication methods for the purpose of account verification, updates, notices, payment reminders, settlement offers, and other information related to their accounts.
This disclosure outlines your rights, our responsibilities, and the conditions under which we may communicate with you.

1. CONSENT TO TEXT & EMAIL COMMUNICATIONS

By providing your mobile number or email address to Kessler & Williams through any method, including online forms, written documents, phone communications, or electronic submission, you expressly agree and consent to receive:

  • SMS text messages

  • MMS media messages

  • Automated or system-generated messages

  • Email notifications

  • Payment reminders

  • Settlement communications

  • Account-related updates

  • Verification requests

  • Important notices required by law

You agree that these communications may be sent using automated technology, including auto-dialer systems, text platforms, or email automation tools.

This consent applies even if your mobile number is listed on any federal, state, or corporate Do-Not-Call registry.

2. PURPOSE OF COMMUNICATIONS

Messages may include, but are not limited to:

  • Missed/declined payment alerts

  • Account updates

K&W makes reasonable efforts to avoid excessive communication and to comply with all FDCPA and state-specific communication restrictions.

4. STANDARD MESSAGE & DATA RATES

​

Message and data rates may apply based on your wireless or internet service provider.
K&W is not responsible for any charges incurred due to text or email communications.

5. OPT-OUT / WITHDRAWAL OF CONSENT

You may opt out of receiving text or email communications at any time.

To stop text messages:

Reply “STOP” to any message sent from us.

To stop email communications:

Send an email to Support@KesslerAndWilliams.com with the subject line “Email Opt-Out”.

Once we receive your request, we will update your communication preferences within a reasonable time frame, typically within 24–72 hours.

Opting out of text/email communication does not stop required notices or legally mandated account communications sent by mail.

6. YOUR RESPONSIBILITIES

By providing your contact information, you agree to:

  • Provide accurate and up-to-date contact information

  • Notify us immediately if your number or email changes

  • Ensure that any mobile number you provide is your personal device and not someone else’s number

  • Acknowledge that texts/emails may be viewed by anyone with access to your device or inbox

K&W is not responsible for unauthorized access to your messages if your device or email account is not secured.

7. PRIVACY & DATA SECURITY

All communications are handled in accordance with our Privacy Policy and applicable federal and state laws, including but not limited to:

  • Fair Debt Collection Practices Act (FDCPA)

  • Telephone Consumer Protection Act (TCPA)

  • California Consumer Privacy Act (CCPA)

  • Any other relevant collection, privacy, or communication regulations

We do not sell consumer information to third parties.

8. NO WARRANTY OF MESSAGE DELIVERY

​

K&W is not responsible for:

  • Delays in message delivery

  • Messages blocked by carriers

  • Spam filtering

  • Device issues

  • Email delivery failures

Consumers are responsible for maintaining a working mobile number and email address.

9. AUTHORIZATION FOR CONTINUED COMMUNICATION

​

By using our website, interacting with our office, providing your contact information, or communicating digitally with K&W, you authorize ongoing text and email communication related to your account until:

  • You request to opt out; or

  • Your account is closed, resolved, or otherwise inactive.
